📦 1) Scope of Services

Services include, but are not limited to: hardware repair, software installation, network troubleshooting, warranty programs, and on-site support. We reserve the right to refuse service at our sole discretion. Any services not explicitly stated in writing are excluded.

🧩 2) Client Responsibilities
  • Access & Information: Provide accurate credentials, facilities, and system info.
  • Data Backups: You are solely responsible for backups. We are not liable for data loss, corruption, downtime, or business interruption.
  • Cooperation: Delays caused by you may result in additional charges.
💳 3) Fees, Payment & Refunds
  • Invoices are due upon receipt unless otherwise agreed in writing.
  • Refunds are not guaranteed and are at our sole discretion.
  • Chargebacks or disputes for delivered services will be treated as fraud and may be pursued via collections or legal action.
  • Live Triage Credit: If you complete a $39.99 Live Triage session before an on-site repair, that amount is credited toward the on-site two-hour minimum ($170) and service must be performed by Tek Guy on Demand.
  • Commercial Printer On-Site Rate: Commercial printer service is billed at $150/hr with a two-hour minimum ($300). Ask about our Fixed Rates!
✈️ 4) Shipping, Handling & Risk of Loss

Risk of loss transfers to Customer at carrier pickup. Tek Guy On Demand is not liable for carrier delays, theft, misdelivery, or damages in transit. See our Shipping Policy.

Ready to ship your laptop in for repair? Start the Mail-In Laptop Form to get your ticket number, packing slip, and step-by-step shipping instructions so we can process your device quickly.

All mail-in laptop repairs are also subject to the Mail-In Laptop Repair Terms & Conditions. By shipping your device to us, you acknowledge and accept those terms in addition to this Service Agreement.

🧱 6) Parts & Materials Policy

Tek Guy On Demand uses OEM (Original Equipment Manufacturer) toner, drums, fusers, and replacement parts by default to ensure top quality and reliability.

In cases where OEM components are discontinued, unavailable, or back-ordered, Tek Guy On Demand may substitute certified new or equivalent parts that meet or exceed OEM specifications.

All installed parts carry a one-year warranty from the date of installation and are fully covered under our No Fix, No Fee policy when used within the scope of normal operation.

Consumables and user-caused damage are excluded.

🔁 6A) Limited Warranty, Returns & RMA Policy

Certain parts sold by Tek Guy On Demand include a limited parts-only warranty. This warranty covers replacement of the defective part only and does not include labor, installation, removal, travel, diagnostics, downtime, or any related damages.

Warranty replacements require initiation of a Return Merchandise Authorization (RMA) and return of the original part prior to replacement shipment.

Important: Replacement of the part is the sole remedy. Labor and service costs are always the responsibility of the customer.
🛠️ 7) Extended Warranty & Service Plans

Extended Warranty, Accidental Damage, Battery Guarantee, and On-Site Service plans are limited to their program descriptions. Exclusions include misuse, neglect, unauthorized modifications, liquid damage (unless covered), and consumables. Replacements may be new, refurbished, or equivalent parts. Learn more: click here.

🔐 8) Confidentiality & Data Security
  • We follow cybersecurity best practices and comply with applicable laws.
  • No guarantee of absolute security is made. Breaches, hacks, or leaks may occur.
  • Maximum liability for any data issue is capped at the amount paid for the specific service.
©️ 9) Intellectual Property

All custom work, documentation, and designs remain property of Tek Guy On Demand unless otherwise agreed in writing. Client is responsible for compliance with third-party software licenses.

📹 10) Remote & Video Sessions
Remote Session Price: $39.99 per session — payable prior to or at start.
On-Site Credit: If this session occurs before an on-site repair, the $39.99 is credited toward the on-site two-hour minimum ($170).

Each session concludes once a diagnosis, instructions, or attempted fix has been provided. No guarantee of resolution is implied unless covered under a written warranty or service plan.

🧰 11) On-Site Service Calls
Two-hour minimum: $170 (includes full diagnostic + initial repair)
Travel: $65/hr from our nearest Tek Guy Support Agent to your site (billing starts on departure; ends on completion).

Pro move: Schedule a Live Triage Session first. We confirm likely causes and parts so we can fix it in one trip—saving time and travel. When Live Triage is completed beforehand, its $39.99 fee is credited toward the $170 on-site minimum.

After the initial two hours, extended labor, parts, or follow-up visits are quoted and billed separately.

📄 12) Customer Responsibility

By requesting on-demand service, you acknowledge Tek Guy On Demand may have limited history or oversight. Diagnosis or repairs may be constrained by information, cooperation, or parts availability.

13) No Fix. No Fee. Policy

We operate a “No Fix. No Fee.” principle. If we are unable to resolve the diagnosed issue, no labor charge will be applied — see the policy to confirm eligibility.

🛡️ 14) General Liability & Insurance
  • We carry $1,000,000 in commercial liability insurance per occurrence.
  • Maximum liability: the lesser of $1,000 or the total amount paid for the service at issue.
  • No indirect, incidental, or consequential damages (lost profits, downtime, etc.).
🤝 15) Independent Contractor Status

Some service personnel may be Tek Guy Vetted independent contractors under Section 1099. No employment relationship is created or implied.

  • Taxes & Benefits: Contractors are responsible for their own taxes; no benefits provided.
  • Methods & Tools: Contractors control means and methods, meeting deadlines/specs.
  • Liability: Contractors carry their own insurance.
  • Payment: Paid on completion; 1099-NEC issued at year-end.
🧨 16) Termination & Cancellation
  • Immediate termination for breach, non-payment, abusive behavior, or fraud.
  • Cancellation requires written notice and may incur fees (see policy).
  • Theft of Services: Non-payment or refusal to pay may be referred to law enforcement.
⚖️ 17) Dispute Resolution
  • First: good-faith negotiation; then mediation; then arbitration. Litigation last.
  • Jurisdiction: Commonwealth of Pennsylvania. Venue: Lycoming County, PA (or nearest competent jurisdiction).
🌪️ 18) Force Majeure

We are not liable for delays, damages, or failures caused by events outside our control (disasters, pandemics, strikes, vendor failures, supply-chain issues, etc.).

📝 19) Amendments

We may update these terms at any time. The current version posted governs. Continued use constitutes acceptance.

📚 20) Entire Agreement

This Agreement supersedes all prior discussions or understandings. No oral agreements are binding.
